Superior Court (1996) 13 Cal.4th 497. Of course, that's sentencing, and he likely doesn't want to plead to a felony with a strike or two. That's what makes strikes tricky though, no washout. As it is, felon in possession of a firearm, 12021.1, straight up felony.

It's really hard to say though since this article is so thin on facts.
