Dear Bay View staff, 

Thank you so much for what you do by way of keeping people of color informed on so many levels. I’m sorry to bother you with this problem after you’ve shown so much kindness to me and many others in my situation, [but there is] continued confiscation of the Bay View and other literature, legal mail, etc. in violation of the settlement agreement.

Summary of events

Around the beginning of 2021, I contacted your office advising you that a suit had been filed against Indiana’s DOC, and as a result the court granted a preliminary injunction barring DOC from banning, blocking, confiscating literature like your newspaper. As a result of that temporary ruling, I forwarded $15 and asked if you’d start a partial subscription which will expire in a month or upon my release this year.

Well, my first two issues got confiscated and I in turn contacted Mrs. Anna Levitt, of IDOC legal department (302 West Washington Street, 46204-2738; Ph. 317-232-5711). I reminded her that she had already ordered the prison to release other prisoners’ Bay Views whose subscriptions predated mine, but I had not received a single issue.

Indiana has denied all requests for re-entry assistance in finding a halfway house.

Mrs. Levitt responded in a letter dated August 16, 2021, “I have instructed Pendleton Correctional Facility* to release the newspapers to you.”

I’m sorry I cannot forward you her letter, but enclosed is one copy of one of these two issues that’s been confiscated. The issues now being held are, I believe, the December 2021 and the January 2022 issues. Please note that I don’t have much time left before my 2022 release. I really need your newspaper because I’m desperately trying to repatriate to my childhood state of California. Indiana has denied all requests for re-entry assistance in finding a halfway house which will accept me there. So now I’ll probably get stuck here so they can try to reimprison me, despite having no further time to serve since 2014. Please help. I’m already being held illegally without due process.
