On May 4, former Black Panther Romaine “Chip” Fitzgerald agreed to a five-year denial of parole instead of insisting on a parole hearing, even though he has served more time than any former Black Panther still behind bars: 49 years. Chip is now 67 years old and living with the consequences of a stroke; his friends and family fear he will die in prison. He has been moved from one state prison to another over the years and is currently in the California State Prison-Los Angeles. I spoke to his lawyer, Charles Carbone, whose office is in San Francisco.

In order to successfully advance in each step of CDCR’s newly enacted Step Down Program (SDP), prisoners are expected to fill out and complete a series of thought policing or brainwashing workbooks. One such workbook is entitled “The Con Game” and purports to elucidate for the prisoner via “self-directed journaling” the ways in which he either consciously or unconsciously is a con artist and criminal.

We are the prisoner class representatives of what’s become known as the PBSP SHU Short Corridor Collective Human Rights Movement. Last month we marked the first anniversary of the end of our historic 60-day Hunger Strike. Oct. 10 we mark the two-year anniversary of the Agreement to End Hostilities. This is an update on where things stand with our struggle to achieve major reforms beneficial to prisoners, outside loved ones and society in general.

Our struggle to abolish SHU torture units is inextricably linked to the broader struggle to seize cultural hegemony in the U.S. from the ruling class and its tool, the state. Our collective efforts have repeatedly exposed the state’s contradictions and sparked the people’s appetite for freedom and new social relationships. These activities undermine the reactionary character structure upon which authoritarian society is based. These actions are thus revolutionary.

Some activists inside the SHUs have said that the ultimate goal was to bring about a shift in public opinion, and that once public consciousness had gotten to the point where the general public in California knew that solitary confinement was torture and had to stop, the balance of power would finally tip. I believe that we are gathering momentum and approaching that time!

Tomorrow, California lawmakers will hold a hearing about the use of solitary confinement inside its state prison system. February marks seven months since people incarcerated throughout California embarked on the mass hunger strike that has drawn legislative attention to prison conditions. The CDCR released new proposed regulations around its gang policies, and it points to changes already made. Accounts from former hunger strikers suggest that change is slow in coming.

Unlike Title 15 – California’s Code of Regulations for all California prisoners – San Quentin top officials have concocted and enacted an exclusive code of regulations called the 608s, which mandate that death row prisoners are under the control of the warden of San Quentin. It is this illegal and repressive code of regulations that AC death row prisoners are vigorously challenging.

The new CDCR proposal will only make things worse by creating the Security Threat Group (STG) designation so as to place thousands more in Ad/Seg-SHU-type units. It’s the only way for CDCR and CCPOA (guards’ union) to recoup some of the loss sustained from the prison population reduction forced by the U.S. Supreme Court ruling in May of 2011.
