An innocent man, DeWayne Ewing wins order to show cause

In January 1994, 23-year-old DeWayne Ewing and a girlfriend discarded a condom as they left a park in the Oakland hills. A rape took place in the same park a few days later, and three days after the rape, police found the condom under a bush and put it with the rape kit. Thirteen years later, in June 2007, police pulled DeWayne over for an illegal turn and arrested him for rape on a cold hit DNA match.

Justice Anthony Kennedy agreed with the majority in its most recent capital punishment case. But in an unusual move, he dedicated almost all of his concurring opinion to condemning the practice of solitary confinement in the nation’s prisons, even though the issue, of his own admission, had “no direct bearing” on the case. In Kennedy’s lengthy opinion concerning how Ayala was incarcerated, he noted that Ayala had been isolated for most of his 25 years of custody.

Secret torture unit at San Quentin

The Adjustment Center (AC) is the death row Security Housing Unit at San Quentin (SQ) which also serves as Administrative Segregation Unit overflow housing. But for all intents and purposes the AC is a secret torture unit at SQ and the fraternal twin of CDCR’s other torture units now partially exposed by media attention resulting from the 2011 peaceful hunger strikes at Corcoran, Pelican Bay and Tehachapi.

If Proposition 34 passes, it will endorse everything that is wrong with the criminal justice system and allow the appeals of innocent people on death row to go unheard. It will take away the one guarantee, through habeas counsel, that death row prisoners have to be able to clear their names and prove their innocence. Sunday afternoon, Feb. 23, at the Museum of the African Diaspora in San Francisco was an opportunity to see what Black Joy looks like. While Africans in Oakland were celebrating what makes us a people, in San Francisco, artists, curators and scholars were discussing Kwame Brathwaite’s work in the “Black is Beautiful: The Photography of Kwame Brathwaite” exhibit up through March 1. More than a tangible aesthetic enumerated, Brathwaite’s “Beautiful” is an opportunity to reflect on the many ways through the ages Blackness – while commodified – transgressed and transcended, even morphed into something completely incomprehensible (in that moment) like Charlie Parker’s “Koko“ or Dizzy Gillespie’s “Shaw ‘Nuff” or John Coltrane’s “A Love Supreme.”
