Phil Taylor: ICTR celebrates 20 years of establishing impunity

Nov. 8, 2014, was the 20th anniversary of the creation of the International Criminal Tribunal on Rwanda, and the court celebrated itself with a new legacy website and video tribute. CIUT-Ontario radio host Phil Taylor called the video contemptible self-promotion and endorsement of Paul Kagame’s military dictatorship in Rwanda.

The International Criminal Tribunal on Rwanda indicted 93 Rwandan Hutus, and no Tutsis, for the 1994 massacres in Rwanda. The court never indicted anyone for the assassinations of the Rwandan and Burundian presidents that shattered Rwanda’s fragile peace and, by the court’s own admission, started the slaughter. KPFA Weekend News Anchor David Rosenberg: Nov. 8 was the 20th anniversary of U.N. Resolution 955, which created the International Criminal Tribunal on Rwanda, and the U.N. has announced a new ICTR legacy website, including a video tribute to its own accomplishments.

During its 20 years in operation, the court indicted 93 Rwandan Hutus, convicted 61 and spent $2 billion. In 2003, former Chief Prosecutor Carla Del Ponte announced that she intended to indict Rwanda’s Tutsi president, Paul Kagame, for the assassination of his predecessor, Rwandan President Juvenal Habyarimana, and Burundian President Cyprien Ntaryamira; but instead, she was summarily fired.

No one was ever indicted for the assassinations, which, by the ICTR’s own admission, shattered a fragile peace and started the ensuing panic and slaughter of 1994. KPFA’s Ann Garrison spoke to Phil Taylor, a former private investigator for ICTR defense attorneys, who became a prominent critic of the court as host of the Taylor Report on CIUT 89.5 FM in Toronto.

Phil Taylor: Yes, one time.

ICTR video tribute: From its first makeshift courtroom, the International Criminal Tribunal for Rwanda went to work on a formidable task. Its mission: to locate, apprehend and prosecute the architects of the genocide. Over the last 20 years, the Tribunal delivered judgments that defined, for the first time, how the world confronts acts of genocide in a court of law.

KPFA: Phil, what do you think?

Phil Taylor: I think it’s shocking, embarrassing that they did this. You know, there’s a proverb that says, “Self-praise is no recommendation.” What I saw was a self-promoting video.

It’s totally inaccurate, and they end up, strangely, by seeming to endorse the current government of Rwanda. And I don’t understand how that has anything to do with the mandate of a tribunal, which was to look into the crimes committed in Rwanda in 1994.

So it shows to me that they really were engaged in a political exercise to basically justify the regime that exists there today, which is a military dictatorship established by Paul Kagame masquerading as a political structure. I think it’s contemptible, when you see such absurd, grand talk about the tribunal, and you hear this actor’s voice – and I’m convinced that is an actor – somebody paid a lot of money for that four-minute, self-promoting video.

KPFA: Oh yeah, they acknowledge that it’s an American television actor.

Phil Taylor: Yeah. And costly. So, to bring it down to saying that now in Rwanda you can listen to the radio and be safe, that is such a caricature, because it is widely known that if you were a broadcaster in Rwanda today, and you were supporting Victoire Ingabire, you would be arrested, and you would not be safe.

Here is the United Nations International Criminal Tribunal on Rwanda putting out propaganda to sustain a one-man dictatorship. That is a disgrace. And that people calling themselves lawyers and judges associate themselves with such a video really just tells you that it was bankrupt from the day it started.

So, indeed it was, exactly what they said it would not be. It was victor’s justice. And the video that they presented is the kind of thing you get from an authoritarian regime. They do not expect to be contradicted. They don’t expect anybody to be allowed to say anything, except themselves.

So it’s like a regime – the ICTR. And it’s a self-congratulating regime. I don’t understand why they have a public relations department to slap them on the back. That seems to be a waste of money and not the purpose of a tribunal.

Phil Taylor: le TPIR célèbre 20 ans d’installation de l’impunité

Le 8 novembre 2014 marquait le 20ème anniversaire de la création du Tribunal pénal international pour le Rwanda (TPIR) et la cour a célébré ce moment par un nouveau site internet dédié à la postérité et une vidéo d’hommage. Phil Taylor, présentateur de la radio CIUT-Ontario a traité la vidéo d’auto-promotion méprisable et d’approbation de la dictature militaire de Kagame au Rwanda.

David Rosenberg, présentateur du journal de KPFA Weekend: le 8 novembre marquait le 20ème anniversaire de la Résolution 955 des Nations-Unies qui institue le Tribunal Pénal international pour le Rwanda. Les Nations Unies ont annoncé la création d’un site internet dédié à la postérité et une vidéo d’hommage à ses réalisations.

Pendant ces 20 ans d’activité, la cour a inculpé 93 hutu rwandais, a condamné 61 personnes et a dépensé 2 milliards de dollars. En 2003, l’ancienne Procureure générale Carla Del Ponte a annoncé son intention d’inculper le président rwandais, tutsi, Paul Kagame, pour l’assassinat de son prédécesseur, le président Juvénal Habyarimana et le président burundais Cyprien Ntaryamira, mais à la place, elle a été virée.

Depuis, personne n’a jamais été inculpé pour ces assassinats, qui pourtant selon les aveux du TPIR, ont mis à mal la paix relative qui régnait au Rwanda et ont déclenché la panique et les atrocités subséquents de 1994. Ann Garrison de KPFA s’est entretenu avec Phil Taylor en sa qualité de responsable de l’émission « Taylor Report » sur la CIUT Toronto, ligne 89,5 FM. Il est ancien enquêteur de la défense auprès du TPIR, devenu par après un virulent critique du Tribunal.

KPFA/Ann Garrison: Phil Taylor, avez-vous visualisé la video d’auto-glorification du 20ème anniversaire du TPIR?

Phil Taylor: oui, une fois.

KPFA: OK, je vais vous faire réécouter le début de la video.

Phil Taylor: Parfait.

Vidéo d’hommage du TPIR: De sa première salle d’audience de fortune, le Tribunal pénal international pour le Rwanda s’est attelé à une tâche redoutable. Sa mission: localiser, appréhender et poursuivre les architectes du génocide. Au cours des 20 dernières années, le Tribunal a rendu des jugements qui ont permis, pour la première fois, de définir comment le monde fait face à des actes de génocide devant un tribunal.

KPFA: Phil, qu’en pensez-vous?

Phil Taylor: Je pense que le fait d’avoir osé déclarer cela est choquant et embarrassant. Vous savez, il y a un proverbe qui dit que « l’auto-glorification n’est pas recommandable ». Ce que j’ai vu est une vidéo d’auto-promotion.

C’est totalement inapproprié et ils finissent, étrangement, par donner blanc-seing aux agissements du gouvernement rwandais. Et je ne comprends pas ce que cela a affaire avec le mandat d’un tribunal qui était censé juger les crimes commis au Rwanda en 1994.

Cela montre clairement que leur seul but était politique, celui de justifier le régime rwandais actuel, – une simple dictature militaire établie par Paul Kagame – en la faisant passer pour une structure politique. Je pense que cela est méprisable, quand vous entendez un discours si absurde, si grandiloquent sur ce tribunal, prononcé par un acteur de télévision – je suis convaincu qu’il s’agit d’un acteur – quelqu’un à qui le Tribunal a payé un paquet d’argent pour cette vidéo d’auto-promotion de quatre minutes.

KPFA: oh oui, ils admettent qu’il s’agit d’un acteur de télévision américain.

Phil Taylor: oui. Et assez cher. Maintenant, dire que vous pouvez écouter la radio au Rwanda sans être inquiété est un pur mensonge parce qu’il est bien connu que si vous étiez un radiodiffuseur aujourd’hui au Rwanda et que vous montriez de la sympathie pour Victoire Ingabire, vous finiriez en prison et vous ne seriez pas du tout en sécurité.

Nous avons ici un Tribunal pénal international pour le Rwanda institué par les Nations Unies qui se livre à de la propagande pour soutenir une dictature d’un seul homme. C’est une honte. Et que des gens se disant avocats et juges s’associent à une telle vidéo vous montre que le tribunal a failli dès son premier jour d’existence.

Ce tribunal était donc le contraire de ce qu’il aurait dû être. Il a été le symbole de la justice du vainqueur. Et la vidéo qu’ils ont montrée ne diffère en rien du genre de vidéos issues des régimes autoritaires. Ils ne s’attendent à aucune contradiction. Ils ne s’attendent pas à ce que quiconque dise quoi que ce soit, eux seuls ont la parole.

Le TPIR est donc semblable à un régime. Et c’est un régime qui s’auto-glorifie. Je ne comprends pas pourquoi le TPIR a un département chargé des relations publiques qui leur casse du sucre sur le dos. C’est une perte d’argent et ce ne sont pas les prérogatives d’un tribunal.
